The impact of the Ghent drug treatment court on drug related life domains: Ciska Wittouck, Saaske De Keulenaer, Stefan Thomaes & Freya Vander Laenen Several countries have implemented a drug treatment court (DTC) at the sentencing level of the criminal justice system (CJS). DTCs aim to refer defendants with substance use disorders (SUDs) to (drug) treatment and counselling services where both the SUD and associated psychosocial difficulties can be addressed. After all recovery from SUDs goes beyond abstinence and all drug related life domains should be considered. The first Belgian DTC is operating since May 5th 2008 in the judicial district of Ghent. In this article we describe the outcomes of the Ghent DTC regarding recidivism, substance use and drug related life domains, based on a study of judicial files. The Ghent DTC shows moderately positive outcomes regarding recidivism, drug treatment, financial counselling and employment. We found no significant differences regarding substance use. The latter can be explained by characteristics of SUDs, the Ghent DTC procedure and the methodology of the study. We can conclude that the collaboration between the CJS and treatment and counselling services, as is the case for DTCs, can be successful. Clear arrangements on the different roles and on professional confidentiality are essential for this collaboration. In addition, we recommend a systematic registration of characteristics of DTC clients, both before and after the DTC trajectory. [ABSTRACT FROM AUTHOR]
Verschillende landen hebben op het berechtingsniveau van de strafrechtsbedeling drugsbehandelingskamers (DBKs) opgericht. DBKs beogen de doorverwijzing van beklaagden met een drugsproblematiek naar de (drugs)hulpverlening, zodat ze daar zowel de drugsproblematiek als de daarmee samenhangende psychosociale moeilijkheden kunnen aanpakken. Herstel na middelengebruik vereist immers een focus op alle drugsgerelateerde levensdomeinen en gaat verder dan het bereiken van abstinentie. Op 5 mei 2008 ging de eerste Belgische DBK van start in het gerechtelijk arrondissement van Gent. In dit artikel beschrijven wij de uitkomsten van de Gentse DBK voor recidive, middelengebruik en drugsgerelateerde levensdomeinen, op basis van een studie van justitiële dossiers. De Gentse DBK laat matig positieve resultaten zien voor recidive, drugshulpverlening, financiële begeleiding en tewerkstelling, maar niet voor middelengebruik. Kenmerken van middelengebruik, van de Gentse DBK en van de methodologie van het onderzoek kunnen dit laatste resultaat verklaren. We kunnen besluiten dat de samenwerking tussen justitie en de hulpverlening op het berechtingsniveau van de strafrechtsbedeling in de vorm van DBKs succesvol kan zijn. Duidelijke afspraken over hun verschillende rollen en het beroepsgeheim zijn hierbij onontbeerlijk. Daarnaast bevelen wij een systematische registratie van de kenmerken van DBK-cliënten aan, zowel voor als na hun traject voor de DBK. [ABSTRACT FROM AUTHOR]
