Professionals have many different motives for working within the criminal justice system – among them, a desire to deliver fairness and justice. Indeed, fairness and justice are integral to the work. But can agencies ever claim to be fair if they are not seen as fair by those they serve? What is fairness if it does not include the perspectives of those experiencing the system? Procedural justice is a concept that provides guidance on how individuals going through the system assess fairness and how system professionals can build trust to improve those perceptions. This chapter discusses a case study of how New York City’s main pretrial agency, the Criminal Justice Agency (CJA), applied procedural justice research to tangible practice improvements on the ground. The specific evidence-informed improvements CJA introduced included: (i) revamping the agency’s pretrial interview and release assessment to prioritize the elements of trust and fairness; (ii) producing respectful and informational written materials for individuals who are arrested and modifying form letters and other written communication; and (iii) implementing agency-wide staff training on the core principles and applications of procedural justice. We begin by summarily introducing the relevant procedural justice and legitimacy literature across various criminal justice contexts and real-world applications, to later describe the experience of the New York City Criminal Justice Agency. We conclude by outlining practical lessons for the implementation of procedural justice practices in other domains of the pretrial context, as well as open research questions that merit further exploration. This discussion is particularly salient in the context of increasing national attention to racial and other disparities in the criminal justice system. As agencies work to respond accordingly and assert their commitment to fairness and justice, procedural justice may offer a meaningful piece of the puzzle in designing and effectuating needed changes.
