Vispārīgā datu aizsardzības regula (VDAR) ir Eiropas Sabiedrības jauns likums personas datu aizsardzības jomā. Tika doti divi gadi lai sagatavoties šim dokumentam. Sagatavošanas darbi bija jāveic gan valsts līmenī – iestādēm, organizācijām, gan privāto jomu pārstāvjiem – uzņēmumiem, fiziskajām personām. Neskatoties uz citiem prognozēm – ne tik pesimistiskām , autoraprāt, pilnībā gatavs nav neviens. Saeima turpina lemt un izskatīt nepieciešamo un Regulā noteikto deleģējuma saturu – Personas datu apstrādes līkumu. Likuma subjekti apmeklē seminārus, lasa vadlīnijas un komentārus un mēģina atrast risinājumus. Datu aizsardzības speciālisti turpina apmācības pēc vecā likuma, Datu valsts inspekcijas pieņem eksāmenus un izdot apliecības, saskaņā ar Ministra kabineta noteikumiem, kuri drīz zaudēs spēku. Viss šis tieši skar divus subjektu grupas - personas datu pārziņus un personas datu apstrādātājus. Šis darbs secīgi un detalizēti analizē un izpēta tiesiskas attiecības, kuras pastāv šo subjektu veidu starpā. Pētījuma mērķis ir noskaidrot iepriekšminēto attiecību zināmus un nezināmus aspektus, atklāt pretrunas un dot iespējamus risinājumus, ja tādi ir. Darba izstrādes procesā iegūtie rezultāti dod praktisko ieskātu pārziņa un apstrādātāja tiesiskajās attiecībās, norada uz iespējamiem riskiem, un ieskicē attiecību regulējošo dokumentu (līguma) saturu un prasības.
General data protection regulation (GDPR) is a brand new European Union law for personal data protection. It was two years given to be prepare for this document. The preparation works were asked to be done on two levels – on the state level, by state organisations and institutions and on the level of private companies and natural person. Not counting the half-pessimistic forecasts, author thinks that prepare is no one. The parliament (Saeima) continues to look through the new by the Regulation delegated local law – Personal data processing law. The subjects of the law attend the seminars, read guidelines and comments, and try to find the solutions. Data protection officers continues to participate the learnings according the old legislation, Data State Inspectorate make examination and issue the certificates, according the regulation of the Cabinet of Ministers, that will loos the validity soon. All this directly inspire two groups of subjects – personal data controllers and personal data processors. This work step by step analyses and discover the legal relations, that exists between this groups. The aim of this research is to find in the previously mentioned relations known and unknown aspects, clear the contradictions un bring the possible solutions, it any exists. The results of the work development process give a practical insight into the legal relationship between the controller and the processor, point out the potential risks, and outline the content and requirements of the documents regulating the relationship (contract).
