Dans l'affaire MGM contre Grokster (réseau d'échange de fichiers peer-to-peer), la Cour Suprême américaine a rejeté la défense consistant à mettre en avant les possibilités d'usages légitimes du réseau. En raison du degré d'infraction constaté et de l'élément d'encouragement à l'infraction, Grookster et Streamcast ont été reconnus responsables de la violation des droits de propriété intellectuelle par procuration, ainsi que de contribution à cette violation. Cette décision pourrait influencer la position du Royaume-Uni.
