I. Introduction Humanity's fascination with outer space is as timeless as it is thought-provoking. Centuries of scientific development eventually disproved Ptolemy's inaccurate, anthropocentric belief that the sun and planets revolved around the Earth. n1 Copernicus refuted Ptolemaic theory and set science on a continuing path from the mystical to the real. The launching of Sputnik-1 n2 and Neil Armstrong's stroll across the moon n3 marked the dawn of the space age, and suggested the need for guiding legal principles in outer space exploration. n4 This Note adopts the Common Heritage of Mankind principle ("CHM"). n5 found in existing international treaties, n6 and uses it as a legal framework to govern future outer space expeditions. This framework would allow future outer space activity to operate in a global, multilateral, and equitable manner. The proposal advanced here reconstitutes existing values and principles of international law. n7 CHM has previously found expression in the 1979 Moon Treaty n8 and the 1982 Law of the Sea Convention. n9 The Outer Space Treaty of 1967 n10 also expresses the CHM intent, n11 though in different terms. n12 The proposal interprets the Outer Space Treaty, the Moon Treaty Law of the Sea Convention, and relevant customary international law, n13 and uses the CHM principle to censure unilateral space activity not consonant with common goals and objectives. n14 Some actions would expressly violate existing treaties, n15 and some would contravene customary international law regarding space. n16 The ...
