I. Introduction "The urge to gamble is so universal and its practice so pleasurable that I assume it must be evil." 1 Surely some of gambling's historic ubiquity is due to its almost biological attachment to people, as the early 20th century American journalist Heywood Broun quoted above and the modern day University of Glasgow Professor Gerda Reith suggest. 2 Gambling, historically, has been ubiquitous-from Biblical accounts of the Roman soldiers who crucified Jesus then cast lots for his clothing, to recent pop culture references like the 1988 movie Rounders and the seminal Kenny Rogers anthem, The Gambler. 3 So if gambling is here to stay, as it seems, what do we do about it? 4 Specifically, regarding online gaming, the answer many jurisdictions have traditionally given is to outlaw it-its virtues, like pleasure and exhilaration, outweighed by its vices, like potential predatory profiting on people's largely unchecked addiction. 5 However, the nature of the Internet raises particular challenges with which traditional legislation has not always dealt competently or completely, such as the location of the Internet for jurisdictional purposes, where activity thereon takes place, and exactly what is online gambling. 6 Some commentators argue for national comprehensive reform of online gambling policies; indeed, Senators Harry Reid (D-NV) and John Kyl (R-AZ) drafted such a bill, which is currently in circulation. 7 This comment skirts the federal proposal discussion, which commentators have already treated competently and thoroughly. 8 This comment also skirts the intricacies of the technological ...
