No procede declarar tan solo la nulidad del derivado financiero (swap) por error vicio al representar un pacto accesorio de otro principal cual es el contrato de leasing. El incumplimiento del deber de información precontractual no supone la nulidad del contrato celebrado en aplicación del art. 6.3 CC.

It is not legally possible to declare just the invalidity of the financial derivative (swap) by mistake due to the fact it represents and additional agreement and not the whole contract. The non-fulfillment of the duty of pre-contractual information does not suppose the invalidity of the contract in application of art. 6.3 CC.
