Inimpugnabilidad de leyes territoriales por gobiernos de la misma comunidad autónoma:: jurisprudencia constitucional… y un precepto “desaparecido” (artículo 32.3 LOTC)

This paper reviews the Constitutional Court’s case law denying the governments of autonomous communities the right to challenge the constitutionality of legislative acts endorsed by the respective autonomic legislature. It also focuses on how to legally “rescue” Article 32.3 of the Act governing the Constitutional Court (LOTC in Spanish), which would have allowed territorial governments to file before the Constitutional Court these “intra-autonomic” appeals. This work also addresses and verifies that, as a matter of fact, Article 32.3 of the LOTC was actually endorsed by the Parliament as part of the full text of this Organic Act, but, interestingly, was never officially published in the Official State Gazette (BOE in Spanish). It also reviews the stance adopted by the most recent Constitutional Court’s case law on whether Article 32.3 of the LOTC is applicable to decide the issue, as well as the grounds of such a decision, together with the development and formulation of proposals on how to properly address (or, where applicable, re-address) and legally tackle this important constitutional problem, both in terms of the model of territorial organisation and of the Spanish model of constitutional justice, not to mention the system of sources of law.

Este artículo examina la jurisprudencia constitucional que deniega a los gobiernos de las comunidades autónomas el derecho a impugnar la constitucionalidad de las leyes aprobadas por la respectiva asamblea legislativa territorial. También aborda cómo “rescatar” jurídicamente el artículo 32.3 LOTC, que habría permitido a los ejecutivos territoriales plantear ante el Tribunal Constitucional tal tipo de impugnaciones “intraautonómicas”. Este trabajo asimismo aborda y verifica que el artículo 32.3 LOTC fue real y efectivamente aprobado por las Cortes Generales formando parte de tal ley orgánica, pero que, extrañamente, nunca fue publicado oficialmente en el BOE. Igualmente es objeto de consideración el posicionamiento adoptado en la más reciente jurisprudencia del Tribunal Constitucional acerca de si el artículo 32.3 LOTC es aplicable a esta cuestión o no, así como los fundamentos de tal decisión, al mismo tiempo que se desarrollan y formulan propuestas acerca de cómo abordar correctamente esta cuestión (o cómo reabordarla, en caso necesario) para dar solución jurídica a este importante problema constitucional, tanto para el modelo de organización territorial como para el modelo español de justicia constitucional, sin olvidar los aspectos relacionados de fuentes del Derecho.
