The Higher Regional Court of Düsseldorf has ruled that the consumer's special termination right according to § 57 TKG (Telecommunications Act) also exists if the mobile phone company cannot base its unilateral contract amendment on a corresponding general terms and conditions clause. The plaintiff, a registered association, demanded that the defendant, a company based in Düsseldorf, refrain from announcing future conditions for the use of its mobile phone services after the discontinuation of the Vodafone Pass and inform the affected customers about their extraordinary termination right. The Higher Regional Court of Düsseldorf has ruled that the termination of the zero-rating option "Vodafone Pass" constitutes a contract amendment and that customers are entitled to a special termination right according to § 57 (1) TKG. The decision of the Higher Regional Court of Düsseldorf is criticized as being brief and insufficiently justified. Das Oberlandesgericht Düsseldorf hat entschieden, dass das Sonderkündigungsrecht des Verbrauchers gemäß § 57 TKG auch dann besteht, wenn das Mobilfunkunternehmen seine einseitige Vertragsänderung nicht auf eine entsprechende AGB-Klausel stützen kann. Der Kläger, ein eingetragener Verein, forderte die Beklagte, ein Unternehmen mit Sitz in Düsseldorf, auf, die Ankündigung der zukünftigen Bedingungen für die Nutzung ihrer Mobilfunkdienstleistungen nach dem Wegfall des Vodafone Passes zu unterlassen und die betroffenen Kunden über ihr außerordentliches Kündigungsrecht zu informieren. Das OLG Düsseldorf hat entschieden, dass die Beendigung der Zero-Rating-Option "Vodafone Pass" eine Vertragsänderung darstellt und den Kunden ein Sonderkündigungsrecht gemäß § 57 Abs. 1 TKG zusteht.
