The article presents a study which focused on the application of nanotechnology in Chinese herbal medicine (CHM). The researchers examined a case wherein a patentee successfully registered over 900 nano-based CHM patents in China's State Intellectual Property Office (SIPO). It was found that the irrational exuberance for patents provides barriers to innovation and invention in the biopharmaceutical industry and the nano-based CHM market.
